Hawaiian Airlines has said that the United States Bankruptcy Court District of Hawaii yesterday (30 October) ruled in favour of Hawaiian Airlines in its lawsuit against Mesa Air Group.
The lawsuit, listed as Case No. 03-00817, resulted in Hawaiian being awarded USD80m in damages. The ruling also ordered Mesa to pay for Hawaiian's litigation and for reasonable attorneys' fees. According to Mark Dunkerley, Hawaiian's president and CEO, evidence presented at trial confirmed a strategy by Mesa to reduce competition in the marketplace.
The airline said the court ruling followed two weeks of proceedings from 25 September through 4 October, including witness testimony and presentation of evidence and that the USD80m was awarded to compensate Hawaiian for damages it suffered through October 2007.
The airline intends to study opinions and applicable law to determine what steps it can take to recover damages it may suffer in subsequent periods, as the compensation was only awarded for damages suffered so far.
